A Wilson County Grand Jury has refused to indict a man in the fatal shooting of 'Toby,' a dog that Army Captain Rachel Ries brought back with her from Afghanistan, 1200 WOAI's Berit Mason reports.

Ries raised thousands of dollars to return the Shepherd mix after the dog 'adopted' her forward helicopter unit during the war, and she didn't want to leave him to the violence of that country.

But it was the violence of this country that ended Toby's life.  Ries says a neighbor shot and killed the dog after claiming Toby was on his property chasing his cats, a charge Ries denies.

"There were so many people involved in bringing home," she told Berit.  "He was just as much the dog of everybody in the unit, and everybody who helped raise money to bring him home.  He was an ideal."

She says she is dissatisfied with the result of the investigation, but she credits widespread media coverage for prompting Wilson County officials to act.

The media and the public have been great," she said.  "We are cognizant of the fact that they were bullied into investigating this thing to begin with."
