The man who was driving that SUV that went out of control and rolled over at Loop 410 and Old Pearsall Road last night, killing two children, has been hit with several serious felony charges, 1200 WOAI news reports.
Rigaberto Morales, 35, of the 6000 block of Stonybrook, is charged with two counts of intoxication manslaughter, and two counts of intoxication assault. He is also charged with violating a protective order.
Police saw Morales arguing with another adult in the front seat of the SUV as they carried four kids in the back. After weaving in and out of traffic, police say Morales flipped his SUV, killing a 10 year old and a 7 year old in the vehicle. The other two children, and Morales and the other adult in the vehicle are all hospitalized. In fact, Morales is booked by proxy, and he will be formally charged after he gets out of the hospital.
Police say none of the four children in the SUV were wearing seat belts.
